Arizona Sentencing Guidelines

Arizona and Federal Mandatory Sentencing Guidelines Attorney

Based in Phoenix, criminal defense attorney Michael Baker is a former public defender who understands the intricacies of both the Arizona Sentencing Guidelines and the Federal Sentencing Guidelines. In many instances, both guidelines require mandatory sentencing based on the severity of the crime and the accused's criminal history.

While the mandatory sentencing guidelines allow judges to deviate from those guidelines under certain circumstances, the guidelines are typically followed unless mitigating or aggravating circumstances exist with which to deviate from those guidelines.

For that reason, we are hesitant to recommend a guilty plea unless we feel, after having thoroughly investigated the law and facts of the case, that the government will be able to prove, beyond any reasonable doubt, that you committed the offense with which you are charged.

Whether you are charged with a drug crime, drunk driving (DUI), assault, or a theft crime, you can rely on Mr. Baker to honorably protect your rights and hold the prosecution to their burden of proof. Contact us today to discuss how we can uncompromisingly defend you.

Arizona Mandatory Sentencing Laws

Arizona prescribes mandatory jail time if you are a repeat felony offender or if you are a first time offender convicted of a dangerous crime, including aggravated assault, assault with a weapon, or the use of a deadly weapon in the commission of a crime, including theft crimes such as armed robbery.

Federal Mandatory Sentencing Guidelines

The federal sentencing guidelines are more complicated than Arizona's sentencing laws. The federal guidelines use a complex formula to place you in a category based on your crime, the circumstances surrounding your crime, and your criminal record. The guidelines require mandatory sentencing within a range of time depending on your category.
