An administrative license revocation (ALR) proceeding is entirely separate from any DUI proceedings and may be commenced in two ways: You had a blood alcohol content (BAC) of .08 or higher or you refused the Breathalyzer or other form chemical testing.

  • BAC of .08 or higher: When you fail the breath test, blood test or other chemical test by producing a reading of .08 blood alcohol content or higher, your license will automatically be suspended for 90 days by the Motor Vehicle Division. This suspension can be challenged only through an administrative license revocation hearing.
  • Breath test refusal: If you are arrested on suspicion of drunk driving and refuse to submit to the Breathalyzer, Intoxilyzer, blood test or any other chemical test at the police station, you are in violation of Arizona implied consent laws and will face an automatic driver's license revocation for one year.
