Diversion and Other Alternatives to Trial
In domestic violence cases, there is usually an opportunity to find an alternative to going to trial. In fact, domestic violence is typically not a formal charge. Defendants are usually charged with an offense such as assault, disorderly conduct or criminal damage. Once we're retained, we will work diligently to help you avoid a trial and limit the damage from these charges.
First, we will advocate for dismissal and if that fails, second for a diversion program. A diversion program will allow a first-time offender to attend anger management classes for six to 20 weeks in exchange for keeping a clean record. Another option is to plead guilty to a lesser misdemeanor and pay a fine to avoid the potential for a felony conviction and jail time.
If the alleged victim fails to cooperate with the police or the prosecution, it may be possible to achieve a dismissal on those grounds at the trial stage due to the defendant not being afforded the right to cross examine the accuser against them
