What are the penalties for marijuana production in Arizona?

For one reason or another, you may choose to grow marijuana plants in Maricopa County. Unless you have a medical marijuana card and meet the requirements, however, this could result in serious drug charges. Under Arizona state law, the production of marijuana is prohibited. In order to protect yourself and your future, it is important for you to understand the potential penalties associated with this offense.

Marijuana production is considered a felony offense in the state of Arizona. The level of felony you may be charged with, and thus the penalties you could face if convicted, vary based on the amount of marijuana you are accused of growing.

If you are charged with producing two pounds, or less, or marijuana, you may be charged with a class 5 felony. The potential penalties for this offense includes a minimum of six months, and a maximum of 2.5 years, in prison. Additionally, you may be fined a minimum of $1,000. If you are granted probation following a conviction of this offense, you will face a mandatory sentence of at least 240 hours of community service.

Producing more than two pounds of marijuana may result in an enhanced charge. If you are charged with producing between two and four pounds of this illegal substance, it is considered a class 4 felony. As such, you could be sentenced to between one and 3.75 years in prison, if you are convicted. You may also be fined at least $1,000.

Marijuana production charges are further enhanced if you are accused of producing four pounds, or more. In these cases, you may be charged with a class 3 felony. This level offense carries a minimum prison sentence of two years, and a maximum sentence of 8.75 years. As is the case with the lower level charges for this offense, you may be fined a minimum of $1,000, or an amount that exhausts the proceeds of your alleged drug offense.
