Why it is important to have an attorney after a DUI arrest

We hope our readers are having a festive and memorable holiday season. In our previous posts, we reported on how holiday DUI enforcement would be increased until New Years' Day, and how the costs of a DUI conviction were not worth drinking and driving. We now want to remind our readers that if someone they knew or love is arrested for drunk driving in Arizona, having an attorney is a necessary defense.

This post will examine why.

Challenge the officer's accounts - Attorneys are well-versed in challenging officer's recollections and facts written in police reports. If you have ever heard someone telling a story about a traumatic (or unusual) event chances are that they have skewed the facts to some extent. Not that they are lying about what they heard (or saw) but there may be subtle differences between what they remember and what actually happened.

When you are charged with a crime, and you are facing real consequences, those subtle differences can mean the difference between guilt and innocence, and a good lawyer can discover those nuances.

It is your constitutional right - The Miranda warning (the advisory that the police are required to give citizens when they are taken into custody) includes the right to remain silent and the right to an attorney. These are very important rights given that officers are trained to elicit information to convict people of crimes, not to find the truth.

We want to wish our readers a safe and festive holiday season and a prosperous 2013.
