Man convicted of drug smuggling has charges dropped

Arizona laws are enacted to keep the public safe. Those laws range from basic traffic rules to legislation surrounding criminal activity. Also a key part of our nation's legal system is the right to fair process and trial that anyone arrested for a crime should have. People accused of drug crimes or other felony charges can sometimes feel that their rights are not thought of but the law does very clearly take the accuracy of the legal process into mind.

News reports detail the case of a Nogales city employee who was convicted last year for solicitation and unlawful transportation of marijuana for sale but who now has had all charges against him dropped due to a process issue. Just weeks before the trial this year, a video was seen showing the U.S. Immigration and Customs Enforcement case agent giving statements that contradicted those that were given by the same agent earlier in the legal process.

The video was apparently available much earlier but was only watched recently, calling into question the legitimacy of the federal case agent's testimony. The city employee with the drug conviction was originally sentenced to a probationary term of four years plus jail time. It is unknown at this point if he will still serve that sentence or not.

Cases like this illustrate the importance of proper protocol when handling criminal charges. Anyone facing a misdemeanor or felony charge is entitled to fair treatment and may wish to consult with an attorney to help learn their rights and ensure they are properly treated.
