The Arizona mandatory sentencing scheme provides the court with what is presumed to be the appropriate sentence for a conviction on a corresponding charge. However, the sentence can be reduced by demonstrating mitigating circumstances or increased if a prosecutor is able to show aggravating circumstances.
Most dangerous offenses, characterized as those involving a vehicle, gun or knife, will come with a mandatory prison sentence. Many drug crimes, particularly those involving meth, or meth for sale, will also have a mandatory prison sentence, typically involving 5, 10 or 15 years in prison depending on the severity of the charge. Those sentences are “flat time,” meaning there will be no credit granted toward early release.
